To use our website and/or receive our services, you must be at least 13 years old or the age of majority in your jurisdiction, whichever is higher, and you must have the legal capacity and authority to enter into these Terms as a binding contract. You are prohibited from using this website and/or receiving services if such use violates any laws or regulations applicable to you or is prohibited in your country.

 

Key commercial Terms offered to customers

When you decide to purchase an item, you agree that: (i) you have fully read the item listing before committing to buy; (ii) you enter into a legally binding agreement to purchase an item when you commit to buy it and finalize the payment during checkout.

 

The prices for our products are displayed on the website. We reserve the right to modify these prices at any time and to correct any pricing errors that may occur inadvertently. For more details on pricing and sales tax, please refer to the payments page.

 

Authorisation to pay

To make payments in our online shop, you must provide your personal details. It is essential that you submit accurate information, including your correct name, phone number, email address, and other necessary details. Additionally, when you order products, you will need to provide accurate payment details and ensure that they are valid and up-to-date. By providing this information, you confirm that you are the person listed in the billing information.

 

The personal information you provide may be shared with one of our partner payment processors, credit reference agencies, or fraud prevention agencies, which may maintain a record of this information.

 

We reserve the right to refuse any order you place with us. We may, at our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may apply to orders made under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. If we modify or cancel an order, we will try to notify you by contacting the email and/or billing address/phone number provided at the time the order was placed. We also reserve the right to limit or prohibit orders that, in our sole judgment, seem to be placed by dealers, resellers, or distributors.

 

Return and refund policy

Returns

You have 14 calendar days to return an item from the date you received it. To be eligible for a return, your item must be unused, unworn, in the same condition that you received it, and still have the original label attached. It must also be in the original packaging.

Refunds

You will be notified once we receive your item. We will immediately notify you on the status of your refund after inspecting the item. If your case is approved, we will initiate a refund to your original method of payment. You will receive the credit within a certain amount of days, depending on your card issuer's policies.

Shipping

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

 

Warranties

When we receive a valid warranty claim for a product purchased from us, we will either repair the relevant defect or replace the product. If we are unable to repair or replace the product within a reasonable time, the customer will be entitled to a full refund upon the prompt return of the product to us.

Coverage

Under our warranty, we've got you covered! For a period of 3 years from the date of purchase, we will take care of any damage to the material or workmanship of your jewellery.

Exclusions

Please note that our warranty does not cover lost items, scratches resulting from normal wear and tear (such as a bent ring or broken chain), improper use or storage of your product, or any modifications performed by a third party outside of Poe Ori.

Third-Party Purchases

Items purchased through a third-party vendor, outside of poeori.com, are not covered under Poe Ori's warranty. In such cases, please contact the company from which the items were purchased for assistance.

 

Data processing

We will process personal data solely in accordance with our prevailing Privacy Policy.

 

Right to suspend or cancel user account

We reserve the right to permanently or temporarily terminate or suspend your access to our services at any time without notice or liability, particularly if we determine that you have breached any part of these Terms or any relevant laws or regulations. You are free to stop using our services and request account cancellation whenever you choose.

 

Indemnification

You agree to indemnify and hold Poe Ori harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

 

Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Poe Ori, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

 

To the maximum extent permitted by applicable law, Poe Ori assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our products; and (iii) any unauthorised access to or use of our secure servers and/or any and all personal information stored therein.

 

Right to change and modify Terms

We retain the right to alter these terms at our discretion. As such, it is advisable for you to review these terms regularly. Should there be a significant modification to the Terms, we will inform you of these material changes. Your continued use of the website following any changes indicates your acceptance of the new Terms. If you do not agree with the terms or any updated versions of the Terms, you should not use or continue to use the website.

 

No waiver

If the customer breaches these Terms and Poe Ori does not take immediate action, this does not mean Poe Ori has waived its rights. Poe Ori retains the right to enforce its rights during any subsequent violations of these Terms by the customer.

 

Preference of law and dispute resolution

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the laws of Switzerland, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Switzerland. Swiss law applies to the exclusion of the UN Sales Convention (CISG).
